    1                        A bill to be entitled                      
    2         An act relating to reinstatement of a revoked health
    3         care practitioner license; amending s. 456.072, F.S.;
    4         requiring, rather than authorizing, health care boards
    5         under the Department of Health to establish rules for
    6         applications for reinstatement of a revoked license;
    7         requiring the boards to grant applicants opportunities
    8         at reasonable intervals to demonstrate certain
    9         competencies; requiring the board to grant an
   10         applicant such initial opportunity within a specified
   11         timeframe; providing examples of evidence the board
   12         may require of an applicant to demonstrate certain
   13         competencies; providing an effective date.
   14          
   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Subsection (6) of section 456.072, Florida
   18  Statutes, is amended to read:
   19         456.072 Grounds for discipline; penalties; enforcement.—
   20         (6) If the board, or the department when there is no board,
   21  determines that revocation of a license is the appropriate
   22  penalty, the revocation shall be permanent. However, the board
   23  shall may establish by rule requirements for reapplication by
   24  applicants whose licenses have been permanently revoked. The
   25  board shall provide a licensee or certificate holder affected
   26  under this subsection an opportunity at reasonable intervals to
   27  demonstrate that he or she can resume the competent practice of
   28  his or her profession with reasonable skill and safety to
   29  patients. The board shall grant an applicant an initial
   30  opportunity to demonstrate such competence within 10 years of
   31  the date of the revocation, if requested within that timeframe.
   32  The requirements may include, but are not limited to, satisfying
   33  current requirements for an initial license, completing 500 or
   34  more hours of practice under the supervision of a health care
   35  professional regulated by the same board as the applicant prior
   36  to revocation, and completing additional continuing education
   37  hours as determined by the board to ensure the competency of the
   38  applicant.
   39         Section 2. This act shall take effect July 1, 2020.
