    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 322.032, F.S.;
    3         creating a competitive, market-based fee that may be
    4         assessed by the Department of Highway Safety and Motor
    5         Vehicles for the use of a credential service provider
    6         for any qualified entity to obtain an electronic ID;
    7         providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (b) of subsection (2) of section
   12  322.032, Florida Statutes, as amended by SB ___, 2019 Regular
   13  Session, is amended to read:
   14         322.032 Electronic credential.—
   15         (2)
   16         (b) The department may assess a competitive, market-based
   17  fee for use of the credential service provider for any qualified
   18  entity to obtain an electronic ID. Revenue generated from use of
   19  the credential service provider by digital identity verifiers
   20  must be shared between the state and the credential service
   21  provider. Revenues must be deposited into the Motor Vehicle
   22  License Clearing Trust Fund for distribution pursuant to
   23  department agreements with digital identity verifiers. Fees may
   24  not be charged to any state court, state governmental entity, or
   25  law enforcement agency.
   26         Section 2. This act shall take effect on the same date that
   27  SB ___ or similar legislation takes effect, if such legislation
   28  is adopted in the same legislative session or an extension
   29  thereof and becomes a law.
