Florida Senate - 2016 SB 588 By Senator Hutson 6-00695-16 2016588__ 1 A bill to be entitled 2 An act relating to special license plates; amending s. 3 320.089, F.S.; providing for a special license plate 4 to be issued to a recipient of the Bronze Star; making 5 technical changes; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Subsection (1) of section 320.089, Florida 10 Statutes, is amended to read: 11 320.089Veterans of the United States Armed Forces; members12of National Guard; survivors of Pearl Harbor; Purple Heart medal13recipients; active or retired United States Armed Forces14reservists; Combat Infantry Badge, Combat Medical Badge, or15Combat Action Badge recipients; Combat Action Ribbon recipients;16Air Force Combat Action Medal recipients; Distinguished Flying17Cross recipients; former prisoners of war; Korean War Veterans;18Vietnam War Veterans; Operation Desert Shield Veterans;19Operation Desert Storm Veterans; Operation Enduring Freedom20Veterans; Operation Iraqi Freedom Veterans; Women Veterans;21World War II Veterans; and Navy Submariners;Special license 22 plates for military service members, veterans, and Pearl Harbor 23 survivors; fee.— 24 (1)(a) Upon application to the department and payment of 25 the license tax for a vehicle as provided in s. 320.08, a 26 resident of this state who owns or leasesEach owner or lessee27ofan automobile or a truck for private use or a recreational 28 vehicle as specified in s. 320.08(9)(c) or (d),which is not 29 used for hire or commercial use,shall be issued a license plate 30 pursuant to the following if the applicant provides the 31 department with proof that he or she meets the qualifications 32 specified in this subsection for the applicable license plate: 33 1. A person released or discharged from any branchwho is a34resident of the state and a veteranof the United States Armed 35 Forces shall be issued a license plate stamped with the term 36 “Veteran” or, upon request,a“Woman Veteran” followed by the 37 serial number of the license plate.,38 2. A World War II veteran shall be issued a license plate 39 stamped with the term “WWII Veteran” followed by the serial 40 number of the license plate.,41 3. A Navy submariner shall be issued a license plate 42 stamped with the term “Navy Submariner” followed by the serial 43 number of the license plate.,44 4. An active or retired member of the Florida National 45 Guard shall be issued a license plate stamped with the term 46 “National Guard” followed by the serial number of the license 47 plate. 48 5. A member of the Pearl Harbor Survivors Association or 49 any other person on active military duty at Pearl Harbor on 50 December 7, 1941, shall be issued a license plate stamped with 51 the term “Pearl Harbor Survivor” followed by the serial number 52 of the license plate., a survivor of the attack on Pearl Harbor,53 6. A recipient of the Purple Heart medal shall be issued a 54 license plate stamped with the term “Combat-wounded Veteran” 55 followed by the serial number of the license plate. The Purple 56 Heart plate may have the term “Purple Heart” stamped on the 57 plate and the likeness of the Purple Heart medal may appear on 58 the plate.,59 7. An active or retired member of any branch of the United 60 States Armed Forces Reserve shall be issued a license plate 61 stamped with the term “U.S. Reserve” followed by the serial 62 number of the license plate. 63 8. A member of the Combat Infantrymen’s Association, Inc., 64 or a recipient of the Combat Infantry Badge, Combat Medical 65 Badge, Combat Action Badge, Combat Action Ribbon, or Air Force 66 Combat Action Medal shall be issued a license plate stamped with 67 the term “Combat Infantry Badge,” “Combat Medical Badge,” 68 “Combat Action Badge,” “Combat Action Ribbon,” or “Air Force 69 Combat Action Medal,” as appropriate, and a likeness of the 70 related campaign medal or badge followed by the serial number of 71 the license plate. 72 9. A recipient of the, orDistinguished Flying Cross shall 73 be issued a license plate stamped with the term “Distinguished 74 Flying Cross” and a likeness of the Distinguished Flying Cross 75 followed by the serial number of the license plate. 76 10. A recipient of the Bronze Star shall be issued a 77 license plate stamped with the term “Bronze Star” and a likeness 78 of the Bronze Star followed by the serial number of the license 79 plate., upon application to the department, accompanied by proof80of release or discharge from any branch of the United States81Armed Forces, proof of active membership or retired status in82the Florida National Guard, proof of membership in the Pearl83Harbor Survivors Association or proof of active military duty in84Pearl Harbor on December 7, 1941, proof of being a Purple Heart85medal recipient, proof of active or retired membership in any86branch of the United States Armed Forces Reserve, or proof of87membership in the Combat Infantrymen’s Association, Inc., proof88of being a recipient of the Combat Infantry Badge, Combat89Medical Badge, Combat Action Badge, Combat Action Ribbon, Air90Force Combat Action Medal, or Distinguished Flying Cross, and91upon payment of the license tax for the vehicle as provided in92s. 320.08, shall be issued a license plate as provided by s.93320.06 which, in lieu of the serial numbers prescribed by s.94320.06, is stamped with the words “Veteran,” “Woman Veteran,”95“WWII Veteran,” “Navy Submariner,” “National Guard,” “Pearl96Harbor Survivor,” “Combat-wounded veteran,” “U.S. Reserve,”97“Combat Infantry Badge,” “Combat Medical Badge,” “Combat Action98Badge,” “Combat Action Ribbon,” “Air Force Combat Action Medal,”99or “Distinguished Flying Cross,” as appropriate, and a likeness100of the related campaign medal or badge, followed by the serial101number of the license plate. Additionally, the Purple Heart102plate may have the words “Purple Heart” stamped on the plate and103the likeness of the Purple Heart medal appearing on the plate.104 (b) Notwithstanding anyother provision oflaw to the 105 contrary,beginning with fiscal year 2002-2003 and annually106thereafter,the first $100,000 in general revenue generated from 107 the sale of license plates issued under this section shall be 108 deposited into the Grants and Donations Trust Fund, as described 109 in s. 296.38(2), to be used for the purposes established by law 110 for that trust fund. Any additional general revenue generated 111 from the sale of such plates shall be deposited into the State 112 Homes for Veterans Trust Fund and used solely to construct, 113 operate, and maintain domiciliary and nursing homes for 114 veterans, subject to the requirements of chapter 216. 115 (c) Any revenue generated from the sale of Woman Veteran 116 license plates must be deposited into the Operations and 117 Maintenance Trust Fund administered by the Department of 118 Veterans’ Affairs pursuant to s. 20.375(3) and must be used 119 solely for the purpose of creating and implementing programs to 120 benefit women veterans. 121 (d) Notwithstanding anyprovisions oflaw to the contrary, 122 an applicant for a Pearl Harbor Survivor license plate or a 123 Purple Heart license plate who also qualifies for a disabled 124 veteran’s license plate under s. 320.084 shall be issued the 125 appropriate special license plate without payment of the license 126 tax imposed by s. 320.08. 127 Section 2. This act shall take effect July 1, 2016.
