1                        A bill to be entitled 
2         An act relating to land management; amending s. 
3         259.032, F.S.; deleting a provision requiring the 
4         Legislature to review certain funding formulas; 
5         providing an effective date.

7  Be It Enacted by the Legislature of the State of Florida: 
8 
9         Section 1. Paragraph (c) of subsection (11) of section 
10  259.032, Florida Statutes, is amended to read: 
11         259.032 Conservation and Recreation Lands Trust Fund; 
12  purpose.— 
13         (11) 
14         (c) The Land Management Uniform Accounting Council shall 
15  prepare and deliver a report on the methodology and formula for 
16  allocating land management funds to the Acquisition and 
17  Restoration Council. The Acquisition and Restoration Council 
18  shall review, modify as appropriate, and submit the report to 
19  the Board of Trustees of the Internal Improvement Trust Fund. 
20  The board of trustees shall review, modify as appropriate, and 
21  submit the report to the President of the Senate and the Speaker 
22  of the House of Representatives no later than December 31, 2008, 
23  which provides an interim management formula and a long-term 
24  management formula, and the methodologies used to develop the 
25  formulas, which shall be used to allocate land management funds 
26  provided for in paragraph (b) for interim and long-term 
27  management of all lands managed pursuant to this chapter and for 
28  associated contractual services. The methodology and formula for 
29  interim management shall be based on the estimated land 
30  acquisitions for the fiscal year in which the interim funds will 
31  be expended. The methodology and formula for long-term 
32  management shall recognize, but not be limited to, the 
33  following: 
34         1. The assignment of management intensity associated with 
35  managed habitats and natural communities and the related 
36  management activities to achieve land management goals provided 
37  in s. 253.034(5) and subsection (10). 
38         a. The acres of land that require minimal effort for 
39  resource preservation or restoration. 
40         b. The acres of land that require moderate effort for 
41  resource preservation or restoration. 
42         c. The acres of land that require significant effort for 
43  resource preservation or restoration. 
44         2. The assignment of management intensity associated with 
45  public access, including, but not limited to: 
46         a. The acres of land that are open to the public but offer 
47  no more than minimally developed facilities; 
48         b. The acres of land that have a high degree of public use 
49  and offer highly developed facilities; and 
50         c. The acres of land that are sites that have historic 
51  significance, unique natural features, or a very high degree of 
52  public use. 
53         3. The acres of land that have a secondary manager 
54  contributing to the overall management effort. 
55         4. The anticipated revenues generated from management of 
56  the lands. 
57         5. The impacts of, and needs created or addressed by, 
58  multiple-use management strategies. 
59         6. The acres of land that have infestations of nonnative or 
60  invasive plants, animals, or fish.

62  In evaluating the management funding needs of lands based on the 
63  above categories, the lead land managing agencies shall include 
64  in their considerations the impacts of, and needs created or 
65  addressed by, multiple-use management strategies. The funding 
66  formulas for interim and long-term management proposed by the 
67  agencies shall be reviewed by the Legislature during the 2009 
68  regular legislative session. The Legislature may reject, modify, 
69  or take no action relative to the proposed funding formulas. If 
70  no action is taken, the funding formulas shall be used in the 
71  allocation and distribution of funds provided in paragraph (b). 
72         Section 2. This act shall take effect July 1, 2010.
