    1                        A bill to be entitled                      
    2         An act relating to physical education in public
    3         schools; amending s. 1003.455, F.S.; revising the
    4         requirements for waiver of student participation in
    5         physical education; authorizing a waiver through
    6         submission of a doctor’s note specifying health
    7         reasons for nonparticipation; providing an effective
    8         date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (4) of section 1003.455, Florida
   13  Statutes, is amended to read:
   14         1003.455 Physical education; assessment.—
   15         (4) The physical education requirement in subsection (3)
   16  shall be waived for a student who meets one of the following
   17  criteria:
   18         (a) The student is enrolled or required to enroll in a
   19  remedial course.
   20         (b) The student’s parent indicates in writing to the school
   21  that:
   22         1. The parent requests that the student enroll in another
   23  course from among those courses offered as options by the school
   24  district; or
   25         2. the student is participating in physical activities
   26  outside the school day which are equal to or in excess of the
   27  mandated requirement.
   28         (c) The student submits to the school’s administration a
   29  doctor’s note that specifies the health reasons as to why the
   30  student should not participate in physical education.
   31         Section 2. This act shall take effect July 1, 2011.
