1                        A bill to be entitled 
2         An act relating to cellular telephone use; creating s. 
3         316.305, F.S.; prohibiting the use of a cellular 
4         telephone while operating a motor vehicle in a school 
5         zone; providing an enhanced penalty; providing an 
6         effective date.

8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1. Section 316.305, Florida Statutes, is created to 
11  read: 
12         316.305 Use of cellular telephones in school zones; 
13  enhanced penalties.— 
14         (1) A person may not operate a cellular telephone while 
15  driving a motor vehicle in a school zone in this state. 
16         (2) A violation of this section is a noncriminal traffic 
17  infraction, punishable as a nonmoving violation as provided in 
18  chapter 318, except that the violator shall pay a fine that is 
19  double the amount provided in chapter 318 for a nonmoving 
20  violation. 
21         Section 2. This act shall take effect July 1, 2010.
