    1                        A bill to be entitled                      
    2         An act relating to statewide environmental resource
    3         permitting rules; amending s. 373.4131, F.S.;
    4         requiring that stormwater management systems be
    5         designed with side slopes that meet a certain minimum
    6         design requirement; superseding certain side slope
    7         rules and authorizing their repeal by a specified
    8         publication of notice and a specified filing;
    9         providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (7) is added to section 373.4131,
   14  Florida Statutes, to read:
   15         373.4131 Statewide environmental resource permitting
   16  rules.—
   17         (7)(a)For purposes of water quality, erosion control, and
   18  ease of maintenance, the side slope of a surface water
   19  management system pond must be designed with a horizontal-to
   20  vertical ratio of 4:1, or an equivalent substitute necessary to
   21  accommodate onsite conditions.
   22         (b)All side slope rules adopted by the department, water
   23  management districts, or delegated local programs under this
   24  part as of July 1, 2024, are superseded by this subsection and
   25  may be repealed without further rulemaking pursuant to s. 120.54
   26  by publication of a notice of repeal in the Florida
   27  Administrative Register and subsequent filing of a list of the
   28  rules repealed with the Department of State.
   29         Section 2. This act shall take effect July 1, 2024.
