    1                        A bill to be entitled                      
    2         An act relating to urban agriculture pilot projects;
    3         amending s. 604.73, F.S.; redefining the term “urban
    4         agriculture” to include both noncommercial and new
    5         commercial agricultural uses; providing applicability;
    6         reenacting ss. 604.40(2) and 604.50(2)(e), F.S.,
    7         relating to farm equipment used in urban agriculture
    8         and to nonresidential farm buildings, farm fences, and
    9         farm signs, respectively, to incorporate the amendment
   10         made to s. 604.73, F.S., in references thereto;
   11         providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Paragraph (b) of subsection (3) of section
   16  604.73, Florida Statutes, is amended, and subsection (6) is
   17  added to that section, to read:
   18         604.73 Urban agriculture pilot projects; local regulation
   19  of urban agriculture.—
   20         (3) DEFINITIONS.—As used in this section, the term:
   21         (b) “Urban agriculture” means any new or existing
   22  noncommercial or new commercial agricultural uses on land that
   23  is:
   24         1. Within a dense urban land area, as described in s.
   25  380.0651(3)(a);
   26         2. Not classified as agricultural pursuant to s. 193.461;
   27         3. Not zoned as agricultural as its principal use; and
   28         4. Designated by a municipality for inclusion in an urban
   29  agricultural pilot project that has been approved by the
   30  department.

   32  The term does not include vegetable gardens, as defined in s.
   33  604.71(4), for personal consumption on residential properties.
   34         (6)APPLICABILITY.—This section does not apply to an urban
   35  agriculture project that is not a pilot project under this
   36  section.
   37         Section 2. For the purpose of incorporating the amendment
   38  made by this act to section 604.73, Florida Statutes, in a
   39  reference thereto, subsection (2) of section 604.40, Florida
   40  Statutes, is reenacted to read:
   41         604.40 Farm equipment.—
   42         (2) This section does not apply to farm equipment that is
   43  used in urban agriculture, as defined in s. 604.73(3).
   44         Section 3. For the purpose of incorporating the amendment
   45  made by this act to section 604.73, Florida Statutes, in a
   46  reference thereto, paragraph (e) of subsection (2) of section
   47  604.50, Florida Statutes, is reenacted to read:
   48         604.50 Nonresidential farm buildings; farm fences; farm
   49  signs.—
   50         (2) As used in this section, the term:
   51         (e) “Urban agriculture” has the same meaning as in s.
   52  604.73(3).
   53         Section 4. This act shall take effect July 1, 2024.
