    1                        A bill to be entitled                      
    2         An act relating to prohibited recordkeeping relating
    3         to firearms or firearm owners; repealing s. 790.335,
    4         F.S., relating to the prohibition of registration of
    5         firearms and the treatment of certain electronic
    6         records; repealing s. 790.336, F.S., relating to
    7         lists, records, or registries required to be
    8         destroyed; amending ss. 409.175 and 790.0625, F.S.;
    9         conforming provisions to changes made by the act;
   10         providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 790.335, Florida Statutes, is repealed.
   15         Section 2. Section 790.336, Florida Statutes, is repealed.
   16         Section 3. Paragraph (c) of subsection (5) and paragraph
   17  (b) of subsection (9) of section 409.175, Florida Statutes, are
   18  amended to read:
   19         409.175 Licensure of family foster homes, residential
   20  child-caring agencies, and child-placing agencies; public
   21  records exemption.—
   22         (5) The department shall adopt and amend rules for the
   23  levels of licensed care associated with the licensure of family
   24  foster homes, residential child-caring agencies, and child
   25  placing agencies. The rules may include criteria to approve
   26  waivers to licensing requirements when applying for a child
   27  specific license.
   28         (c) The requirements for the licensure and operation of a
   29  child-placing agency shall also include compliance with the
   30  requirements of s. 63.0422 ss. 63.0422 and 790.335.
   31         (9)
   32         (b) Any of the following actions by a family foster home or
   33  its household members or an agency or its personnel is a ground
   34  for denial, suspension, or revocation of a license:
   35         1. An intentional or negligent act materially affecting the
   36  health or safety of children in the home or agency.
   37         2. A violation of this section or of licensing rules
   38  adopted pursuant to this section.
   39         3. Noncompliance with the requirements for good moral
   40  character as specified in paragraph (5)(b).
   41         4. Failure to dismiss personnel or remove a household
   42  member found in noncompliance with requirements for good moral
   43  character.
   44         5. Failure to comply with the requirements of s. 63.0422
   45  ss. 63.0422 and 790.335.
   46         Section 4. Paragraph (a) of subsection (6) of section
   47  790.0625, Florida Statutes, is amended to read:
   48         790.0625 Appointment of tax collectors to accept
   49  applications for a concealed weapon or firearm license; fees;
   50  penalties.—
   51         (6)(a) A tax collector appointed under this section may not
   52  maintain a list or record of persons who apply for or are
   53  granted a new or renewal license to carry a concealed weapon or
   54  firearm. A tax collector who violates this paragraph commits a
   55  felony of the third degree, punishable as provided in s. 775.082
   56  or s. 775.083 violation of this paragraph is subject to s.
   57  790.335.
   58         Section 5. This act shall take effect July 1, 2022.
