Florida Senate - 2017 SB 82 By Senator Steube 23-00212-17 201782__ 1 A bill to be entitled 2 An act relating to postsecondary education tuition and 3 fee waivers; amending s. 1009.26, F.S.; deleting a 4 requirement that a state university, Florida College 5 System institution, career center operated by a school 6 district, or charter technical career center waive 7 out-of-state fees for certain students, including 8 certain undocumented students, who meet specified 9 requirements; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (12) of section 1009.26, Florida 14 Statutes, is amended to read: 15 1009.26 Fee waivers.— 16(12)(a) A state university, a Florida College System17institution, a career center operated by a school district under18s. 1001.44, or a charter technical career center shall waive19out-of-state fees for students, including, but not limited to,20students who are undocumented for federal immigration purposes,21who meet the following conditions:221. Attended a secondary school in this state for 323consecutive years immediately before graduating from a high24school in this state;252. Apply for enrollment in an institution of higher26education within 24 months after high school graduation; and273. Submit an official Florida high school transcript as28evidence of attendance and graduation.29(b) Tuition and fees charged to a student who qualifies for30the out-of-state fee waiver under this subsection may not exceed31the tuition and fees charged to a resident student. The waiver32is applicable for 110 percent of the required credit hours of33the degree or certificate program for which the student is34enrolled. Each state university, Florida College System35institution, career center operated by a school district under36s. 1001.44, and charter technical career center shall report to37the Board of Governors and the State Board of Education,38respectively, the number and value of all fee waivers granted39annually under this subsection. By October 1 of each year, the40Board of Governors for the state universities and the State41Board of Education for Florida College System institutions,42career centers operated by a school district under s. 1001.44,43and charter technical career centers shall annually report for44the previous academic year the percentage of resident and45nonresident students enrolled systemwide.46(c) A state university student granted an out-of-state fee47waiver under this subsection must be considered a nonresident48student for purposes of calculating the systemwide total49enrollment of nonresident students as limited by regulation of50the Board of Governors. In addition, a student who is granted an51out-of-state fee waiver under this subsection is not eligible52for state financial aid under part III of this chapter and must53not be reported as a resident for tuition purposes.54(d) A state university, a Florida College System55institution, a career center operated by a school district under56s. 1001.44, or a charter technical career center shall, within57the nonresident student enrollment systemwide, prioritize the58enrollment of a veteran who is granted an out-of-state fee59waiver pursuant to the Congressman C.W. “Bill” Young Tuition60Waiver Act over a student who is granted an out-of-state fee61waiver under this subsection.62 Section 2. This act shall take effect July 1, 2017.
