HB 4055

1	A bill to be entitled
2	An act relating to assisted living facilities; amending s.
3	429.178, F.S.; removing a provision that exempts an
4	assisted living facility that provides special care for
5	persons with Alzheimer's disease or other related
6	disorders from the requirement to pay for certain training
7	and education programs; providing an effective date.

9	Be It Enacted by the Legislature of the State of Florida:

11	Section 1.  Subsection (8) of section 429.178, Florida
12	Statutes, is renumbered as subsection (7), and present
13	subsection (8) of that section is amended to read:
14	429.178  Special care for persons with Alzheimer's disease
15	or other related disorders.-
16	(7)  Any facility more than 90 percent of whose residents
17	receive monthly optional supplementation payments is not
18	required to pay for the training and education programs required
19	under this section. A facility that has one or more such
20	residents shall pay a reduced fee that is proportional to the
21	percentage of such residents in the facility. A facility that
22	does not have any residents who receive monthly optional
23	supplementation payments must pay a reasonable fee, as
24	established by the department, for such training and education
25	programs.
26	Section 2.  This act shall take effect July 1, 2011.
