HB 4047

1	A bill to be entitled
2	An act relating to assisted living facilities; amending s.
3	429.41, F.S.; removing an obsolete provision requiring the
4	Department of Elderly Affairs to submit to the Legislature
5	for review and comment a copy of proposed department rules
6	establishing standards for resident care; providing an
7	effective date.

9	Be It Enacted by the Legislature of the State of Florida:

11	Section 1.  Subsections (4) and (5) of section 429.41,
12	Florida Statutes, are renumbered as subsections (3) and (4),
13	respectively, and present subsection (3) of that section is
14	amended to read:
15	429.41  Rules establishing standards.-
16	(3)  The department shall submit a copy of proposed rules
17	to the Speaker of the House of Representatives, the President of
18	the Senate, and appropriate committees of substance for review
19	and comment prior to the promulgation thereof. Rules promulgated
20	by the department shall encourage the development of homelike
21	facilities which promote the dignity, individuality, personal
22	strengths, and decisionmaking ability of residents.
23	Section 2.  This act shall take effect July 1, 2011.
