HB 4039

1	A bill to be entitled
2	An act relating to hypnosis; repealing ch. 485, F.S.,
3	relating to hypnosis; amending ss. 490.0141 and 491.0141,
4	F.S., to conform; providing an effective date.

6	Be It Enacted by the Legislature of the State of Florida:

8	Section 1.  Chapter 485, Florida Statutes, consisting of
9	sections 485.001, 485.002, 485.003, 485.004, and 485.005, is
10	repealed.
11	Section 2.  Section 490.0141, Florida Statutes, is amended
12	to read:
13	490.0141  Practice of hypnosis.-A licensed psychologist who
14	is qualified as determined by the board may practice hypnosis as
15	defined in s. 485.003(1). The provisions of this chapter may not
16	be interpreted to limit or affect the right of any person
17	qualified pursuant to chapter 485 to practice hypnosis pursuant
18	to that chapter or to practice hypnosis for nontherapeutic
19	purposes, so long as such person does not hold herself or
20	himself out to the public as possessing a license issued
21	pursuant to this chapter or use a title protected by this
22	chapter.
23	Section 3.  Section 491.0141, Florida Statutes, is amended
24	to read:
25	491.0141  Practice of hypnosis.-A person licensed under
26	this chapter who is qualified as determined by the board may
27	practice hypnosis as defined in s. 485.003(1). The provisions of
28	this chapter may not be interpreted to limit or affect the right
29	of any person qualified pursuant to chapter 485 to practice
30	hypnosis pursuant to that chapter or to practice hypnosis for
31	nontherapeutic purposes, so long as such person does not hold
32	herself or himself out to the public as possessing a license
33	issued pursuant to this chapter or use a title protected by this
34	chapter.
35	Section 4.  This act shall take effect July 1, 2011.
