A bill to be entitled
2An act relating to state lotteries; creating s. 24.132,
3F.S.; providing for a special instant scratch-off lottery
4game titled Ticket for the Cure; providing for revenues to
5be used for the purpose of funding breast cancer research
6and services for certain breast cancer victims; providing
7restrictions for the use of funds; defining the terms "net
8revenue" and "research"; authorizing the Department of the
9Lottery to adopt rules; amending s. 24.121, F.S.;
10providing for revenues to be equitably apportioned to
11certain state universities to be used for the purpose of
12funding breast cancer research and services for certain
13breast cancer victims; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Section 24.132, Florida Statutes, is created to
18read:
19     24.132  Ticket for the Cure.-
20     (1)  The department shall offer a special instant scratch-
21off lottery game with the title "Ticket for the Cure." The game
22shall commence on January 1, 2012, and shall be discontinued on
23December 31, 2017. During the time that tickets are sold for the
24Ticket for the Cure game, the department may not unreasonably
25diminish the efforts devoted to marketing any other instant
26scratch-off lottery game.
27     (2)(a)  The net revenue from the Ticket for the Cure
28scratch-off game shall be allocated pursuant to s. 24.121(5)(f)
29to be used for the purpose of funding breast cancer research and
30services for low-income, uninsured breast cancer victims. The
31funds may not be used for institutional, organizational, or
32community-based overhead costs, indirect costs, or levies.
33     (b)  As used in this section, the term:
34     1.  "Net revenue" means the total amount for which tickets
35have been sold less the sum of the amount paid out in prizes and
36the actual administrative expenses of the department solely
37related to the Ticket for the Cure game.
38     2.  "Research" includes, but is not limited to,
39expenditures to develop and advance the understanding,
40techniques, and modalities effective in the detection,
41prevention, screening, and treatment of breast cancer, including
42clinical trials.
43     (3)  The department may adopt rules to implement this
44section.
45     Section 2.  Paragraph (b) of subsection (5) of section
4624.121, Florida Statutes, is amended, present paragraph (f) is
47redesignated as paragraph (g), and a new paragraph (f) is added
48to that subsection, to read:
49     24.121  Allocation of revenues and expenditure of funds for
50public education.-
51     (5)
52     (b)  Except as provided in paragraphs (c), (d), and (e),
53and (f), the Legislature shall equitably apportion moneys in the
54trust fund among public schools, community colleges, and
55universities.
56     (f)  The net revenues received pursuant to s. 24.132 shall
57be equitably apportioned to state universities that have medical
58research facilities or that are associated with medical research
59facilities. The moneys shall be used for the purpose of funding
60breast cancer research and services for low-income, uninsured
61breast cancer victims pursuant to s. 24.132.
62     (g)(f)  Each school district shall, on a quarterly basis,
63make available to the public and distribute, in an easy to
64understand format, the expenditures of lottery funds allocated
65to the school district.
66     Section 3.  This act shall take effect July 1, 2011.
