1	A bill to be entitled
2	An act relating to motor vehicle operation; prohibiting
3	smoking in a motor vehicle in which certain minors are
4	passengers; providing for secondary enforcement; providing
5	penalties; providing an effective date.

7	Be It Enacted by the Legislature of the State of Florida:

9	Section 1.  (1)  A person who smokes or possesses any
10	lighted tobacco product in a motor vehicle in which a minor who
11	is younger than 7 years of age or weighs less than 60 pounds is
12	a passenger commits a nonmoving violation, punishable as
13	provided in chapter 318, Florida Statutes.
14	(2)  Enforcement of this section must be accomplished only
15	as a secondary action when a driver has been detained for a
16	suspected violation of another offense.
17	Section 2.  This act shall take effect July 1, 2011.
