1	A bill to be entitled
2	An act relating to grandparent visitation; amending s.
3	752.01, F.S.; providing additional grounds for awarding a
4	grandparent visitation with a grandchild; providing an
5	effective date.

7	Be It Enacted by the Legislature of the State of Florida:

9	Section 1. Subsection (1) of section 752.01, Florida
10	Statutes, is amended to read:
11	752.01 Action by grandparent for right of visitation; when
12	petition shall be granted.-
13	(1) The court shall, upon petition filed by a grandparent
14	of a minor child, award reasonable rights of visitation to the
15	grandparent with respect to the child if when it is in the best
16	interest of the minor child and if:
17	(a) The marriage of the parents of the child has been
18	dissolved;
19	(b) The parent of the child who is the son or daughter of
20	the grandparent is deceased and the grandparent had a
21	relationship with the child before the death of the parent;
22	(c)(b) A parent of the child has deserted the child; or
23	(d)(c) The minor child was born out of wedlock and not
24	later determined to be a child born within wedlock as provided
25	in s. 742.091.
26	Section 2. This act shall take effect July 1, 2010.
