A bill to be entitled
2An act relating to taxi operators; authorizing
3governmental units that regulate the operation of taxis to
4create a private property right in the license to operate
5a taxi; providing for the transfer of such property right;
6providing definitions; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  (1)  Any governmental unit that is authorized
11to regulate the operation of taxis within its geographic
12boundaries may adopt ordinances, rules, regulations, orders, or
13other acts that create a private property right or interest in a
14license to operate a taxi within the geographic boundaries of
15the governmental unit.
16     (2)  Upon the creation of such private property right, the
17owner of a taxi operation may pledge, sell, assign, sublease, or
18otherwise transfer the license to another person. However, the
19owner must apply to the governmental unit before making such
20transfer and obtain its approval for the proposed action, except
21that a license may be transferred by operation of intestate
22succession or devise.
23     (3)  As used in this section, the term:
24     (a)  "License" includes any certificate, permit, medallion,
25or other evidence that authorizes a person to operate a taxi
26within the geographic boundaries of a governmental unit.
27     (b)  "Governmental unit" includes a county, municipality,
28special district, commission, or other unit of state or local
29government.
30     Section 2.  This act shall take effect July 1, 2011.
