A bill to be entitled
2An act relating to trust funds; creating s. 551.317,
3F.S.; creating the Destination Resort Trust Fund
4within the Department of Gaming Control; providing for
5the purpose of the trust fund; providing for future
6review and termination or re-creation of the trust
7fund; providing a contingent effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 551.317, Florida Statutes, is created
12to read:
13     551.317  Destination Resort Trust Fund.-
14     (1)  The Destination Resort Trust Fund is created within
15the Department of Gaming Control.
16     (2)  The trust fund is established for the deposit of
17licensing fees of destination resorts and the proceeds of gross
18receipts taxes imposed on destination resorts. Funds may be
19expended only pursuant to legislative appropriation or an
20approved amendment to the Department of Gaming Control's
21operating budget pursuant to chapter 216, Florida Statutes.
22     (3)  In accordance with s. 19(f)(2), Art. III of the State
23Constitution, the trust fund shall, unless terminated sooner, be
24terminated on July 1, 2016. Before its scheduled termination,
25the trust fund shall be reviewed as provided in s. 215.3206(1)
26and (2).
27     Section 2.  This act shall take effect on the same date
28that HB 487 or similar legislation takes effect, if such
29legislation is enacted in the same legislative session, or an
30extension thereof, and becomes law, and only if this act is
31enacted by a three-fifths vote of the membership of each house
32of the Legislature.
