A bill to be entitled
2An act relating to the state employees' prescription
3drug program; amending s. 110.12315, F.S.; requiring
4the Department of Management Services to authorize
5certain pharmacies to dispense 90-day maintenance
6prescription medication to certain patients;
7specifying a dispensing fee for a 90-day prescription
8supply; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsections (3) through (7) of section
13110.12315, Florida Statutes, are renumbered as subsections (4)
14through (8), respectively, and a new subsection (3) is added to
15that section to read:
16     110.12315  Prescription drug program.-The state employees'
17prescription drug program is established. This program shall be
18administered by the Department of Management Services, according
19to the terms and conditions of the plan as established by the
20relevant provisions of the annual General Appropriations Act and
21implementing legislation, subject to the following conditions:
22     (3)  The Department of Management Services shall authorize
23any retail pharmacy licensed in this state and participating in
24the program to dispense a 90-day maintenance prescription
25medication to a program member, subscriber, or covered dependent
26with a chronic disease, including, but not limited to, heart
27disease, diabetes, HIV/AIDS, end-stage renal disease, or cancer.
28The dispensing fee for a 90-day supply shall be 1.5 times the
29amount paid for a 30-day supply.
30     Section 2.  This act shall take effect July 1, 2012.
