A bill to be entitled
2An act relating to resisting an officer or other specified
3person without violence; amending s. 843.02, F.S.;
4providing that resistance, obstruction, or opposition must
5be based on factors other than mere flight from an officer
6or other person to whom this section applies; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 843.02, Florida Statutes, is amended to
12read:
13     843.02  Resisting officer or other such person without
14violence to his or her person.-Whoever shall resist, obstruct,
15or oppose any officer as defined in s. 943.10(1), (2), (3), (6),
16(7), (8), or (9); member of the Parole Commission or any
17administrative aide or supervisor employed by the commission;
18county probation officer; parole and probation supervisor;
19personnel or representative of the Department of Law
20Enforcement; or other person legally authorized to execute
21process in the execution of legal process or in the lawful
22execution of any legal duty, without offering or doing violence
23to the person of the officer or other such person, commits shall
24be guilty of a misdemeanor of the first degree, punishable as
25provided in s. 775.082 or s. 775.083. For purposes of this
26section, resistance, obstruction, or opposition must be based on
27factors other than mere flight from an officer or other person
28to whom this section applies.
29     Section 2.  This act shall take effect July 1, 2011.
