A bill to be entitled
2An act relating to postsecondary student fees; creating s.
31009.215, F.S.; providing an exemption from payment of
4nonresident tuition at a state university or a Florida
5College System institution for an undocumented student who
6meets specified requirements; requiring the Board of
7Governors of the State University System to adopt
8regulations and the State Board of Education to adopt
9rules; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 1009.215, Florida Statutes, is created
14to read:
15     1009.215  Nonresident tuition exemption.-
16     (1)  Beginning with the 2011 fall term, an undocumented
17student, other than a nonimmigrant alien within the meaning of 8
18U.S.C. s. 1101(a)(15), is exempt from paying nonresident tuition
19at a state university or a Florida College System institution if
20the student meets all of the following requirements:
21     (a)  Attended high school in the state for 3 or more years,
22which need not be consecutive.
23     (b)  Graduated from a high school in the state or attained
24a high school equivalency diploma pursuant to s. 1003.435.
25     (c)  Registered as an entering student or is currently
26enrolled at a state university or a Florida College System
27institution.
28     (d)  Files an affidavit with the state university or the
29Florida College System institution stating that the student has
30filed an application to legalize his or her immigration status
31or will file an application as soon as he or she is eligible to
32do so.
33     (2)  The Board of Governors shall adopt regulations and the
34State Board of Education shall adopt rules to implement the
35nonresident tuition exemption provided in this section.
36     Section 2.  This act shall take effect July 1, 2011.
