A bill to be entitled
2An act relating to compensation of county officials;
3amending ss. 145.031, 145.051, 145.071, 145.09, 145.10,
4and 145.11, F.S.; authorizing each member of a board of
5county commissioners, each clerk of the circuit court,
6county comptroller, each sheriff, each supervisor of
7elections, each property appraiser, and each tax collector
8to reduce his or her salary on a voluntary basis;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 145.031, Florida Statutes, is amended
14to read:
15     145.031  Board of county commissioners.-
16     (1)  Each member of the board of county commissioners shall
17receive as salary the amount indicated, based on the population
18of his or her county. In addition, compensation shall be made
19for population increments over the minimum for each population
20group, which shall be determined by multiplying the population
21in excess of the minimum for the grouping times the group rate.

32     (2)  No member of a governing body of a chartered county or
33a county with a consolidated form of government shall be deemed
34to be the equivalent of a county commissioner for the purposes
35of determining the compensation of such member under his or her
36respective charter.
37     (3)  Notwithstanding the provisions of this section or s.
38145.19, each member of the board of county commissioners may
39reduce his or her salary rate on a voluntary basis.
40     Section 2.  Section 145.051, Florida Statutes, is amended
41to read:
42     145.051  Clerk of circuit court; county comptroller.-
43     (1)  Each clerk of the circuit court and each county
44comptroller shall receive as salary the amount indicated, based
45on the population of his or her county. In addition, a
46compensation shall be made for population increments over the
47minimum for each population group, which shall be determined by
48multiplying the population in excess of the minimum for the
49group times the group rate.

59     (2)(a)  There shall be an additional $2,000 per year
60special qualification salary for each clerk of the circuit court
61who has met the certification requirements established by the
62Supreme Court. Any clerk of the circuit court who is certified
63during a calendar year shall receive in that year a pro rata
64share of the special qualification salary based on the remaining
65period of the year.
66     (b)  In order to qualify for the special qualification
67salary provided by paragraph (a), the clerk must complete the
68requirements established by the Supreme Court within 6 years
69after first taking office.
70     (c)  After a clerk meets the requirements of paragraph (a),
71in order to remain certified the clerk shall thereafter be
72required to complete each year a course of continuing education
73as prescribed by the Supreme Court.
74     (3)  Notwithstanding the provisions of this section or s.
75145.19, each clerk of the circuit court and each county
76comptroller may reduce his or her salary rate on a voluntary
77basis.
78     Section 3.  Section 145.071, Florida Statutes, is amended
79to read:
80     145.071  Sheriff.-
81     (1)  Each sheriff shall receive as salary the amount
82indicated, based on the population of his or her county. In
83addition, a compensation shall be made for population increments
84over the minimum for each group, which shall be determined by
85multiplying the population in excess of the minimum for the
86group times the group rate.

96     (2)(a)  There shall be an additional $2,000 per year
97special qualification salary for each sheriff who has met the
98qualification requirements established by the Department of Law
99Enforcement. Any sheriff who so qualifies during a calendar year
100shall receive in that year a pro rata share of the special
101qualification salary based on the remaining period of the year.
102     (b)  In order to qualify for the special qualification
103salary described in paragraph (a), the sheriff must complete the
104requirements specified in that paragraph within 6 years after
105first taking office.
106     (c)  After a sheriff meets the requirements of paragraph
107(a), in order to remain qualified the sheriff shall thereafter
108be required to complete each year a course of continuing
109education as prescribed by the Department of Law Enforcement.
110     (3)  Notwithstanding the provisions of this section or s.
111145.19, each sheriff may reduce his or her salary rate on a
112voluntary basis.
113     Section 4.  Section 145.09, Florida Statutes, is amended to
114read:
115     145.09  Supervisor of elections.-
116     (1)  Each supervisor of elections shall receive as salary
117the amount indicated, based on the population of his or her
118county. In addition, a compensation shall be made for population
119increments over the minimum for each population group, which
120shall be determined by multiplying the population in excess of
121the minimum for the group times the group rate.

131     (2)  The above salaries are based upon a 5-day workweek. If
132a supervisor does not keep his or her office open 5 days per
133week, then the salary will be prorated accordingly.
134     (3)(a)  There shall be an additional $2,000 per year
135special qualification salary for each supervisor of elections
136who has met the certification requirements established by the
137Division of Elections of the Department of State. The Department
138of State shall adopt rules to establish the certification
139requirements. Any supervisor who is certified during a calendar
140year shall receive in that year a pro rata share of the special
141qualification salary based on the remaining period of the year.
142     (b)  In order to qualify for the special qualification
143salary described in paragraph (a), the supervisor must complete
144the requirements established by the Division of Elections within
1456 years after first taking office.
146     (c)  After a supervisor meets the requirements of paragraph
147(a), in order to remain certified the supervisor shall
148thereafter be required to complete each year a course of
149continuing education as prescribed by the division.
150     (4)  Notwithstanding the provisions of this section or s.
151145.19, each supervisor of elections may reduce his or her
152salary rate on a voluntary basis.
153     Section 5.  Section 145.10, Florida Statutes, is amended to
154read:
155     145.10  Property appraiser.-
156     (1)  Each property appraiser shall receive as salary the
157amount indicated, based on the population of his or her county.
158In addition, a compensation shall be made for population
159increments over the minimum for each population group, which
160shall be determined by multiplying the population in excess of
161the minimum for the group times the group rate.

171     (2)(a)  There shall be an additional $2,000 per year

173met the requirements of the Department of Revenue and has been
174designated a certified Florida property appraiser. Any property
175appraiser who is certified during a calendar year shall receive
176in that year a pro rata share of the special qualification
177salary based on the remaining period of the year. The department
178shall establish and maintain a certified Florida property
179appraiser program.
180     (b)  In order to qualify for the special qualification
181salary described in paragraph (a), the property appraiser must
182complete the requirements established by the Department of
183Revenue within 4 years after first taking office.
184     (c)  After a property appraiser meets the requirements of
185paragraph (a), in order to remain certified the property
186appraiser shall thereafter be required to complete each year a
187course of continuing education as prescribed by the department.
188The executive director of the Department of Revenue may, at his
189or her discretion, waive the requirements of this paragraph for
190any property appraiser who has reached 60 years of age and who
191has been a property appraiser for 20 years.
192     (3)  Notwithstanding the provisions of this section or s.
193145.19, each property appraiser may reduce his or her salary
194rate on a voluntary basis.
195     Section 6.  Section 145.11, Florida Statutes, is amended to
196read:
197     145.11  Tax collector.-
198     (1)  Each tax collector shall receive as salary the amount
199indicated, based on the population of his or her county. In
200addition, a compensation shall be made for population increments
201over the minimum for each population group, which shall be
202determined by multiplying the population in excess of the
203minimum for the group times the group rate.

213     (2)(a)  There shall be an additional $2,000 per year

215the requirements of the Department of Revenue and has been
216designated a certified Florida tax collector. Any tax collector
217who is certified during a calendar year shall receive in that
218year a pro rata share of the special qualification salary based
219on the remaining period of the year. The department shall
220establish and maintain a certified Florida tax collector
221program.
222     (b)  In order to qualify for the special qualification
223salary described in paragraph (a), the tax collector must
224complete the requirements established by the Department of
225Revenue within 4 years after first taking office.
226     (c)  After a tax collector meets the requirements of
227paragraph (a), in order to remain certified the tax collector
228shall thereafter be required to complete each year a course of
229continuing education as prescribed by the department.
230     (3)  Notwithstanding the provisions of this section or s.
231145.19, each tax collector may reduce his or her salary rate on
232a voluntary basis.
233     Section 7.  This act shall take effect July 1, 2011.
