       The Committee on Judiciary (Stargel) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 297 - 302
    4  and insert:
    5  authority. The petitioner has the burden to prove by a
    6  preponderance of the evidence that it would be substantially
    7  affected by the proposed rule of going forward. The agency then
    8  has the burden to prove by a preponderance of the evidence that
    9  the proposed rule is not an invalid exercise of delegated
