       Senator Farmer moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 67 - 69
    4  and insert:
    5  to the prevailing party. If the local government is the
    6  prevailing party, damages must include any taxpayer costs
    7  incurred in defending the action. An award of reasonable
    8  attorney fees or costs and damages pursuant to this subsection
    9  may not exceed $50,000. In addition, the prevailing party may
   10  not recover any

   14         Between lines 5 and 6
   15  insert:
   16         specifying that damages recoverable by a prevailing
   17         local government include certain taxpayer costs;
