SENATE JOINT RESOLUTION NO. 11

DIRECTING THE DEPARTMENT OF TRANSPORATION TO CONDUCT A SOUND LEVEL STUDY ON INTERSTATE 495 IN AREAS ADJACENT TO RESIDENTIAL NEIGHBORHOODS IN DELAWARE



WHEREAS, highway traffic generated noise is typically a combination of noise composed of; (1) tire and pavement interaction, (2) engine operation, and (3) exhaust expulsion.   

WHEREAS, highway traffic noise and construction noise has important environmental impacts and can interfere with normal human activities. 

WHEREAS, the Department of Transportation ("DelDOT") has established a Noise Abatement policy to lessen the impact of highway traffic noise on people in neighborhoods and in other noise-sensitive areas, such as churches, schools, hospitals and certain public recreational areas.

WHEREAS, noise abatement is any measure, practice, or action that reduces noise emanating from highways as heard at specific locations that would be sensitive to highway noise.

Whereas, DelDOT has the ability to use specialized consultants to study the noise characteristics at specific locations to identify areas that exceed threshold levels of traffic noise that could warrant implementation of noise abatement measures.

NOW, THEREFORE:

BE IT RESOLVED by the Senate and the House of Representatives of the 147th General Assembly of the State of Delaware, with the approval of Governor, that DelDOT shall, as soon as possible, conduct a sound level study on Interstate 495 in areas adjacent to residential neighborhoods in Delaware and report to the General Assembly their preliminary findings and recommendations for noise abatement before the reopening of I-495.


SYNOPSIS

This joint resolution directs DelDOT to immediately conduct a sound level study and report the results to the General Assembly before the reopening of I-495. These studies can be compared with previous high traffic noise levels.
