SENATE BILL NO. 67

AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE TO AUTHORIZE THE PLACEMENT OF MEMORIAL SIGNAGE FOR CERTAIN EMERGENCY PERSONNEL KILLED IN THE LINE OF DUTY.



WHEREAS, the Federal Manual on Uniform Traffic Control Devices ("MUTCD"), published by the Federal Highway Administration under 23 CFR, Part 655, Subpart F, specifically recognizes that legislative bodies may permit the memorialization of individuals by signage on highways, bridges, and other components of highways; and

WHEREAS, MUTCD recognizes certain standards for such signage; and

WHEREAS, the General Assembly of the State of Delaware, with the approval of the Governor, feels that it is appropriate to authorize signage to memorialize the service of Michelle Smith and Stephanie Callaway, and also to provide for memorial signage for other emergency personnel that may be tragically lost on a Delaware road while serving in the line of duty.

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 17, Delaware Code, by adding a §531, to read as follows:

"§531. Memorial Signage.

Notwithstanding any law or regulation to the contrary, memorial signs for firefighters, EMS Personnel, or law enforcement officers killed along a Delaware road or highway in the line of duty are specifically authorized to be placed along the road near the place such person was killed.Such signage shall be constructed and installed in accordance with the Federal Manual on Uniform Traffic Control Devices, as published by the Federal Highway Administration under 23 CFR, Part 655, Subpart F."

Section 2.Notwithstanding any law or regulation to the contrary, memorial signage for Michelle Smith and Stephanie Callaway is hereby expressly authorized and shall be dedicated in accordance with the standards for such signs in the MUTCD.


SYNOPSIS

This Bill specifically authorizes Michelle Smith and Stephanie Calloway's memorial signage at the locations of their deaths to commemorate their service and the tragic loss of their lives while serving in the line of duty.It also authorizes future placement of such signs for emergency personnel killed along roadways in the line of duty.
