DELAWARE STATE SENATE

146th GENERAL ASSEMBLY

SENATE BILL NO. 55

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO TRAFFIC CONTROL SIGNAL PREEMPTION DEVICES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend §4112A, Title 21, Delaware Code, by adding a subsection (e) to read as follows:

"(e) Vehicles identified in paragraph (2) and (3) of subsection (d) of this section may operate a traffic control preemption device when such vehicles are returning to their assigned duty station entranceways or driveways, but only to affect the operation of the traffic control signal or signals permitting direct access of such vehicles to their assigned duty stations' entranceways or driveways."

Section 2. Amend §4112A(b) and (c), Title 21, Delaware Code, by adding after the phrases "subsection (d)" as found in each subsection, the phrase "or subsection (e)".


SYNOPSIS

This Bill expands the permissible use of traffic signal preemption devices to permit emergency vehicles to return into fire stations.
