SENATE BILL NO. 34

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO THE REGIONAL GREENHOUSE GAS INITIATIVE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend �6045(b), Title 7, Delaware Code by making insertions as shown by underlining and deletions as shown by strikethrough as follows:

�6045 Auctions of allowances.

(b) The Secretary need not establish, implement or manage the elements of the allowance auction program by regulation. However, the Secretary shall publish the elements of the auction program in the Delaware Register of Regulations no less than 60 days prior to Delaware's participation in its first auction. The Secretary may modify the auction program as the Secretary deems necessary, but substantive modifications shall also be published in the Delaware Register of Regulations. Any reduction in allowances below 6,803,808 short tons of CO2, increases in the reserve price for permits, or changes to price caps for permits must be approved by a Joint Resolution of the General Assembly.

SYNOPSIS

This Bill requires that changes to the Delaware Regional Greenhouse Gas Initiative allowance auction program involving reduction in allowances below 6,803,808 short tons of CO2, increases in the reserve price for permits, or changes to price caps for permits must be approved by a Joint Resolution of the General Assembly.
