DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 232

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO CIVIL ADMINISTRATIVE PROCEDURES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend §10128, Chapter 101, Title 29 of the Delaware Code by adding a new subsection "(f)" as follows:

"When any professional licensing board or commission governed by Title 23, 24, or 28, and listed in §10161(a) of this chapter, orders, at the conclusion of a hearing, that a license shall be revoked or suspended, the revocation or suspension shall be effective immediately.A written order, pursuant to §10128 of this Chapter, shall be served no later than 30 days after the hearing date."


SYNOPSIS

The purpose of this Bill is to ensure that when a professional licensing board revokes or suspends a license at a hearing, the revocation or suspension shall be effective immediately.However, the Bill also requires that a written order must be served within 30 days after the hearing date.
