SENATE BILL NO. 207

AN ACT TO AMEND TITLE 15 OF THE DELAWARE CODE RELATING TO CANDIDATE COMMITTEES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 80, Title 15, Delaware Code by inserting at the end of Subchapter I thereof the following:

"§8007.Termination of a candidate committee due to the death of the candidate.

(a)When a candidate dies with funds remaining in his or her candidate committee(s), the remaining funds shall first pay the creditors of the candidate committee, on a pro-rata basis if the amounts owed exceed the amount of the remaining funds.All funds remaining after paying the creditors shall be distributed pursuant to the guidelines in §8022 of this Title.

(b)The Treasurer of the candidate committee shall be responsible for the distribution of the candidate committee funds and deciding how the remaining funds are to be contributed or donated pursuant to §8022 of this Title.If the Treasurer position is vacant, the Alternate Contact on the Statement of Organization shall be responsible.If both positions shall be vacant, the Head of the State Political Party with which the candidate was affiliated (or the State Commissioner of Elections if the candidate had no political affiliation) shall be responsible.

(c)All distributions required by this section and the closing of the candidate committee(s) shall be completed within 6 months of the candidate's death.".

Section 2.Amend §8043(a), Title 15, Delaware Code by deleting "or §8005" as it appears therein and by inserting in lieu thereof ", §8005 or §8007".

Section 3.This Act shall not apply to any candidate committee whose candidate has died prior to this Act's enactment into law.


SYNOPSIS

This Act limits the life of a candidate committee to 6 months after the death of the candidate for which it was formed.Some candidate committees have been distributing funds for years after the death of the candidate.This Act shall not apply to any candidate committee whose candidate has died prior to this Act's enactment into law.
