DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 187

AN ACT PROPOSING AN AMENDMENT TO ARTICLE VII OF THE DELAWARE CONSTITUTION RELATING TO THE DEATH PENALTY.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend Section 1, Article VII of the Delaware Constitution by adding to the first paragraph thereof as follows:

"Notwithstanding the above limitations, the Governor shall have the absolute power to commute a sentence of death to a sentence of life imprisonment without possibility of probation or parole."


SYNOPSIS

This 1st Leg of a Constitutional Amendment would grant the Governor the power to commute a death sentence to a sentence of life imprisonment without possibility of probation or parole.Currently a majority of the Board of Pardons must first recommend such a commutation.
