DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 130

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO MOTOR VEHICLES AND BRAKES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §4303(c), Title 21 of the Delaware Code by deleting subsection (c) in its entirety:

SYNOPSIS

The Bill removes the ban on "Jake Brakes" which applies to motor vehicles generally, but not emergency vehicles. The purpose of Jake Brakes is to slow the vehicle when approaching a stop light, stop sign or just slowing down for any reason. Most of these systems have a switch on the dash to activate it which cuts the fuel off when the accelerator is lifted. The regular brakes do not have to be applied as hard or as soon and thus saves the drums and brake shoes which also saves money for the owners. If an owner normally has three brake replacements a year this system can reduce it to one to two replacements a year. This can be a potential savings of two to three thousand dollars a year. This system also costs the owner approximately $2,000.00 to $2,500.00 extra to have it installed on the vehicle at the factory. This system has a safety advantage when traveling on ice and snow and when it is activated a truck can slow down without locking up the brakes. The ban was imposed because of the noise the braking system can cause without proper mufflers; however, enforcing equipment and noise laws should suffice to curb noise violators.
