148th GENERAL ASSEMBLY

HOUSE RESOLUTION NO. 21

ESTABLISHING A WORKING GROUP ON FINES AND COLLECTIONS BY THE VOLUNTARY ASSESSMENT CENTER.



WHEREAS, the state has an interest in enforcing the rules of the road; and

WHEREAS, an important part of that enforcement is the imposition of traffic fines and penalties; and

WHEREAS, the Voluntary Assessment Center, the Division of Motor Vehicles and other entities charged with the adjudication and collection of penalties for minor traffic offenses cooperate daily in the management of the process; and

WHEREAS, Senate Bill No. 132, introduced by the 148th General Assembly makes changes to the practice of suspending driver's licenses for failure to timely pay fines and fees for minor traffic offenses; and

WHEREAS, the collection of those fines should be fair, just and efficient;

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 148th General Assembly of the State of Delaware that the Traffic Fines Working Group be formed to explore best practices and possible improvements to the process of imposing and collecting fines for minor traffic offenses.

BE IT FURTHER RESOLVED that the Working Group be composed of the following members:

(1) Chief Magistrate of the Justice of the Peace Court or designee.

(2) Secretary of DelDOT or designee, who shall serve as Chairperson of the Working Group, and DelDOT shall provide administrative support to the Working Group.

(3) Director of DMV or designee.

(4) DELJIS Director or designee.

(5) A member of the Senate to be appointed by the President Pro Tempore of the Senate.

(6) A member of the House of Representatives to be appointed by the Speaker of the House.

(7) A member to be appointed by the Governor.

BE IT FURTHER RESOLVED that a report of findings and recommendations from the Working Group shall be delivered to the Governor, President Pro Tempore of the Senate and the Speaker of the House of Representatives on or before January 31, 2016.


SYNOPSIS

This House Resolution establishes the Traffic Fines Working Group to explore best practices and possible improvements to the process of imposing and collecting fines for minor traffic offenses.The Working Group will report its findings to the Governor, President Pro Tempore of the Senate and the Speaker of the House of Representatives on or before January 31, 2016.
