HOUSE CONCURRENT RESOLUTION NO. 68
REQUESTING THE COUNTIES AND MUNICIPALITIES CONFER AND PROVIDE RECOMMENDATIONS FOR IMPROVING ACCESSIBLE PARKING INFRASTRUCTURE, ENFORCEMENT, AND COMPLIANCE TO THE GENERAL ASSEMBLY.
WHEREAS, the Americans with Disabilities Act (ADA) was signed into law on July 26th, 1990; and
WHEREAS, a major tenant of the ADA was ensuring accessible parking infrastructure; and
WHEREAS, it has been over 30 years since the ADA went into effect; and
WHEREAS, numerous parking lots across the state are not compliant with ADA standards; and
WHEREAS, changes during the COVID-19 pandemic saw further eroding of accessible parking infrastructure in Delaware; and
WHEREAS, Delaware does not have a strong enforcement model to protect accessible parking infrastructure from misuse or from unauthorized changes; and
WHEREAS, the General Assembly has a strong interest in ensuring Delawareans in need of accessible parking are able to enjoy our businesses and amenities; and
WHEREAS, accessible parking legislation has been introduced in the General Assembly with clear goals and targets; and
WHEREAS, the county and municipal governments of Delaware are instrumental in regulating and enforcing parking rules throughout the State; and
WHEREAS, it is in the interest of the state to ensure that legislation passed is enforceable and actionable by county and municipal governments.
NOW, THEREFORE:
BE IT RESOLVED by the House of Representatives of the 152nd General Assembly of the State of Delaware, the Senate concurring therein, that representatives from New Castle County, Kent County, Sussex County, and the League of Local Governments are requested to convene to provide recommendations on improving accessible parking enforcement, compliance, signage, and uniformity to the General Assembly as follows:
(1) The recommendations should provide actionable steps designed to meet the goals set out in House Bill No. 175 of the 152nd General Assembly, including but not limited to, improved signage, enforcement, plan review, scooter user access, and maintaining existing accessible parking infrastructure.
(2) The recommendations should, where practicable, focus on improving the already existing framework of House Bill No. 175, including the review of plans when practicable after passage of new legislation from the General Assembly on accessible parking standards.
BE IT FURTHER RESOLVED that the county and municipal representatives should transmit these recommendations to the Chief Clerk of the House of Representatives, the Secretary of the Senate, and the Director of the Division of Research by November 15th, 2023.

This resolution asks representatives from New Castle County, Kent County, Sussex County, and the League of Local governments to convene to provide recommendations for improving accessible parking enforcement, compliance, signage, and uniformity in the State of Delaware.
