HOUSE BILL NO. 87

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO CRIMES AND SPECIFIC OFFENSES AGAINST THE PERSON.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §612(a)(3), Title 11 of the Delaware Code by inserting the phrase "public transit operator," after the phrase "a deputy sheriff," and before the phrase "a code enforcement constable".

Section 2.Amend §613(a)(5), Title 11 of the Delaware Code by inserting after the phrase "public transit operator," after the phrase "fire marshall," and before the phrase "a code enforcement constable".


SYNOPSIS

This Bill protects public transit operators by including that position in the list of other positions, such as volunteer firefighters and paramedics, that result in heightened levels for crimes in which the operator was a victim.A person who intentionally causes physical injury to a public transit operator who is acting in the lawful performance of duty is guilty of an assault in the second degree, a class D felony, rather than an assault in the third degree, a class A misdemeanor.A person who intentionally causes serious physical injury to a public transit operator who is acting in the lawful performance of duty is guilty of an assault in the first degree, a class B felony, rather than an assault in the second degree.
