HOUSE BILL NO. 433

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DIVISION OF DEVELOPMENTAL DISABILITIES SERVICES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Section 7909A, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows and redesignating accordingly:

§7909A. Division of Developmental Disabilities Services.

(e) Beginning in fiscal year 2017, the Division of Disabilities Services shall phase in increases to the rates paid to providers of services that are based on the Instrument for Client and Agency Planning assessment process.  By the year 2020, these rates shall be 100 percent of the market rates.


SYNOPSIS

This bill would mandate an increase in the rates paid according to the Instrument for Client and Agency Planning assessment so that by the year 2020 the state achieves funding providers at 100% of the market rate. The state is currently funding providers at 75% of the market rate. The ICAP is an assessment instrument that is used to determine the number of support hours based on each individual's unique needs, challenges and strengths.These rate increases are necessary in order to keep people with intellectual and developmental disabilities safe and integrated to the maximum extent possible in their local communities.
