HOUSE BILL NO. 413

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO FINES, COSTS, PENALTIES AND FORFEITURES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §4101(h)(4)a.1., Title 11 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(4) The Fund to Combat Violent Crimes Committee shall administer the moneys distributable to local law-enforcement agencies hereunder. The Committee shall be comprised of 5 members, namely the Secretary of the Department of Safety and Homeland Security, the Superintendent of the Delaware State Police, the Attorney General, the President of the Delaware Police Chiefs Council and the President of the Delaware State Lodge of the Fraternal Order of Police, or the respective designees of such members. The Secretary of the Department of Safety and Homeland Security shall be the chairperson of the Committee.

a.1. A detailed description of how the requested funds will be used by the local law-enforcement agency to combat violent crime or improve the delivery of police services to their respective jurisdictions;

Section 2.Amend §4101(h)(9)d. of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(9) For purposes of this section:

d. "Local law-enforcement agency'' means any county or municipal police department within this State including the University of Delaware Police Department, The Delaware State University Police Department, The Delaware River and Bay Authority Police Department, the Delaware State Capital Police Department, The Delaware State Division of Alcohol and Tobacco Enforcement Department. The Delaware Natural Resources and Environmental Control State Park Police, Environmental Control Police and Fish and Wildlife Police Divisions, and the Office of State Fire Marshal, but does not include any county sheriff's office or the Delaware State Police.


SYNOPSIS

This bill gives more flexibility in how law enforcement may use funds from the Fund to Combat Violent Crimes. Additionally, the bill expands the definition of "local law enforcement agency". finally, the bill allows law enforcement to use less detailed descriptions of how requested funds will be used to combat violent crime. This will help law enforcement protect case sensitive information.
