HOUSE BILL NO. 299

AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO NOTIFICATION OF REFUGEE RESETTLEMENT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 1, Title 16 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 112.Notification of refugees from certain federally designated countries

The Secretary of the Department of Health and Social Services, in coordination with the Delaware Refugee Coordinator, shall immediately notify the Governor and the Secretary of the Department of Safety and Homeland Security, by written or electronic means of any refugee who has been selected for resettlement in this state and who has lived within the preceding five (5) years in a country determined by the United States Secretary of State to have provided support for acts of international terrorism pursuant to §6(j) of the Export Administration Act of 1979 (50 U,S,C, §4605(j)), §620A of the Foreign Assistance Act of 1961 (22 U.S.C. §2371), or §40 of the Arms Export Control Act (22 U.S.C. §2780).Unless otherwise prohibited by federal law, the notification shall include identifying information of the refugee and the location selected for resettlement of the refugee in this state.


SYNOPSIS

This bill requires the Secretary of the Department of Health and Social Services to immediately notify the Governor and the Secretary of the Department of Safety and Homeland Security of any refugee being resettled in this state if such refugee has lived within the preceding five years in a country determined by the U.S. Secretary of State to have provided support for acts of international terrorism pursuant to certain federal laws.
