HOUSE BILL NO. 292

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 57, Title 25 of the Delaware Code by adding a new §5719 to read as follows:

"§ 5719.Petition for review by Superior Court.

(a)Any person or persons, jointly or severally aggrieved by any decision of the Justice of the Peace Court made in the exercise of its appellate function under §5717 of this title, may present to the Superior Court a petition, duly verified, setting forth that such decision is illegal, in whole or in part, specifying the grounds of the illegality. Such petition shall be presented to the Superior Court within 15 days of the final order, ruling, decision or judgment.

(b)The record reviewed by the Superior Court in furtherance of subsection (a) shall include:(i) a transcript of the trial and related hearings; (ii) all orders, rulings, decisions, and/or judgments issued by the trial court; (iii) original papers or exhibits; and (iv) any materials considered by the trial court and necessary to disposition on appeal.".


SYNOPSIS

This Act allows any person or persons, jointly or severally aggrieved by any decision of the Justice of the Peace Court made in the exercise of its appellate function, to petition for review by the Superior Court.
