HOUSE BILL NO. 278

AN ACT TO AMEND TITLE 2 OF THE DELAWARE CODE RELATING TO RAILROADS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 18, Title 2 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 1824. Crew requirement for movement of railroad freight.

(a) Except as set forth in subsection (b) of this section, a train or light engine used in connection with the movement of railroad freight may not be operated in this State unless the train or light engine has a crew of at least 2 individuals.

(b) This subsection does not apply to movement in a railroad yard.

(2) A railroad that commits a second or subsequent violation within a period of 3 years is subject to a fine of $1,000 for each offense.

SYNOPSIS

This Act requires that a train or light engine used to move freight by railroad have a crew of at least 2 individuals. Violation of this statute subjects the railroad to a $500 fine for a first offense, and a $1,000 fine for a second or subsequent offense within 3 years of the first offense.
