HOUSE BILL NO. 221

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO MUNICIPAL AND COUNTY CONSTRUCTION PREVAILING WAGE STUDY ACT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Add a new Section to Title 29 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 6960A. Exemption

Any construction contract entered into by any county or municipal government located in this state shall be exempted from the provisions of § 6960 of this chapter.

§ 6960B. Cost Study Comparison Report

Any county or municipality utilizing the exemption granted under § 6960A of this chapter shall prepare a comparison report of project costs incurred in the first 2 years utilizing the exemption versus what the costs would have been if no exemption was applicable. This cost study comparison report shall be submitted to the Delaware Controller General’s Office within 27 months of the effective date of this act. The Controller General’s Office shall establish a cost study comparison report form to be used for reports required under this section and shall prepare a summary report compiling the results of the cost study comparison reports.

Section 2. This Act shall sunset three years after its effective date.

Section 3. The Controller General’s summary report shall be distributed to the members of the General Assembly 30 months after the effective date of this act.

SYNOPSIS

This bill creates a 3-year exemption for county and municipal government contracts from prevailing wage requirements. Also the local governments will prepare cost study comparison reports for the Controller General's Office to compile and report to the General Assembly.
