HOUSE BILL NO. 21

AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO PERSONAL ACTIONS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §8145, Chapter 81, Title 10, Delaware Code by adding a new subsection to read as follows:

"(d) Any award of damages to a plaintiff pursuant to this section shall not include prejudgment interest.".

Section 2.If any provision of this Act or the application thereof is held invalid, such invalidity shall not affect the provisions of this Act that can be given effect without such invalid provisions or application, and to this end the provisions of this Act are declared to be severable.

Section 3.This Act shall become effective July 9, 2007.


SYNOPSIS

This legislation excludes prejudgment interest from damages awarded pursuant to § 8145, Title 10, Delaware Code.
