AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO CERTAIN PROPERTY CRIMES. |
Section 1.Amend §841, Title 11 of the Delaware Code in the title thereof by inserting after the language "Theft;" and before the language "class G felony" the phrase "class B felony; class D felony; class F felony;".
Section 2.Amend §841(c)(3), Title 11 of the Delaware Code by striking the phrases "class E felony" and "class C felony" as they appear therein and substituting in lieu thereof, respectively, the phrases "class D felony" and "class B felony".
Section 3.Amend §913A, Title 11 of the Delaware Code in the title thereof by striking the phrase "class G felony; class E felony; class C felony" and substituting in lieu thereof the phrase "class B felony; class D felony; class G felony".
Section 4.Amend §913A(c)(2), Title 11 of the Delaware Code by striking the phrase "class E felony" as it appears therein and substituting in lieu thereof the phrase "class D felony".
Section 5.Amend §913A(c)(3), Title 11 of the Delaware Code by striking the phrase "class C felony" as it appears therein and substituting in lieu thereof the phrase "class B felony".
Section 6.Amend §917, Title 11 of the Delaware Code in the title thereof by striking the phrase "class C felony, class F felony, class G felony, class A misdemeanor" and substituting in lieu thereof the phrase "class B felony; class D felony; class G felony; class A misdemeanor".
Section 7.Amend §917(d)(2), Title 11 of the Delaware Code by striking the phrase "class F felony" as it appears therein and substituting in lieu thereof the phrase "class D felony".
Section 8.Amend §917(d)(3), Title 11 of the Delaware Code by striking the phrase "class C felony" as it appears therein and substituting in lieu thereof the phrase "class B felony".
SYNOPSIS
This Act raises the penalties for the three property crimes that have enhancements for property losses in excess of $50,000 and $100,000.When the loss is in excess of $50,000, the crime would be a class D felony (0 to 8 years imprisonment) instead of a class E felony (0 to 5 years imprisonment) or class F felony (0 to 3 years imprisonment).When the loss is in excess of $100,000, the crime would be a class B felony (2 to 25 years imprisonment) instead of a class C felony (0 to 15 years imprisonment). |
