HOUSE BILL NO. 140

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO RULES OF THE ROAD.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend §4116, Title 21 of the Delaware Code by inserting new subsections "(3)" through "(5)" reading as follows:

"(3) Upon any roadway having 4 or more lanes for moving traffic and 2 lanes traveling in the same direction, a vehicle must stay in the right travel lane except to pass a slower moving vehicle, or to make a legal left turn.

(4) On a roadway with three or more lanes traveling in the same direction, a vehicle shall use the center travel lane or the right travel lane, except when entering or exiting the roadway, or when passing a slower moving vehicle.

(5) A person who violates this section by driving continuously in the left lane of a multilane roadway when it impedes the flow of other traffic shall, for the first offense, be fined not less than $28.75, nor more than $230.00. For each subsequent like offense within 2 years, the person shall be fined not less than $57.50, nor more than $575.00.".


SYNOPSIS

This bill is intended to prohibit slower moving vehicles from driving in the left lane and blocking traffic, which commonly leads to road rage and has motivated several other states to adopt "left lane" laws. This bill provides that vehicles may overtake slower moving vehicles on the left, but otherwise shall not drive in the left lane, which is intended to serve as the passing lane.The Code already provides that a vehicle being passed shall not increase its speed.There is an exception in the bill for making a legal left turn.This bill also establishes fines for violations of these provisions.
