HOUSE BILL NO. 106

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO SPEED RESTRICTIONS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 41, Title 21 of the Delaware Code by making deletions as shown by strike through and additions as shown by underline as follows:

§4169. Specific speed limits; penalty.

(d) The Department of Transportation shall designate a maximum speed limit of 65 miles per hour for all portions of Delaware State Route 1 located between the Red Lion Creek and the Appoquinimink River, except for the delineated non-highway speed toll plaza area.Such maximum limits may be posted on fixed or variable signs. Any speed in excess of such displayed limits shall be absolute evidence that the speed is not reasonable or prudent and that it is unlawful.


SYNOPSIS

This Bill clarifies that the Department of Transportation can set and post a lower speed limit at the delineation of the non-highway speed toll plaza area along Delaware State Route 1.
