AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE RELATING TO REGULATION OF TRAFFIC. |
Section 1.Amend §141, Chapter 1, Title 17, Delaware Code by adding the following subsection thereto:
"(f) Notwithstanding any law, rule, or regulation to the contrary, the Department shall:
(1) Require a Traffic Impact Study or Traffic Operational Analysis for every development or redevelopment application where the population density of the subject site will increase beyond that density for the subject site immediately prior to the application being submitted to the Department.
(2) Require any Traffic Impact Study or Traffic Operational Analysis to analyze at least three (3) intersections closest to each entrance or exit of a project and at least one (1) intersection that is fully controlled by signal if one (1) of the studied intersections is not so controlled.This paragraph shall not limit the Department from the evaluation of more intersections if it deems such analysis is necessary.
(3) Require a Traffic Operational Analysis for all projects over 50,000 square feet or more of structure or when the Traffic Impact Study shows an increase of 10% or more of traffic at the intersection closest to the project's entrance.
(4) Require any Traffic Impact Studies or Traffic Operational Analyses to list all bridges located within a half-mile radius that are listed in the publication required by paragraph (5) of this subsection.
(5) Annually publish a public notice alerting the public of any bridge the State classifies as needing reconstruction or repairs.".

This bill requires the Department of Transportation to require certain studies, analyses, and publications for certain development or redevelopment. |
