Summary

Currently, 14 Del. C. 3122 implements requirements under the Individuals With Disabilities Education Act (“IDEA”) regarding the duty of school districts to locate, identify, and evaluate all children in need of special education and related services. The IDEA was amended to require that local school districts identify, locate, and evaluate all children who are in need of special education and related services and attending private schools at the election of their parents when the private schools being attended are located within the school district boundaries. This Act clarifies state law provisions regarding the “child find” duty in a manner consistent with current IDEA requirements. The Act also amends the administrative hearing system under the Individuals with Disabilities Education Act and 14 Del. C. 3101 et seq. relating to hearing panels that address complaints from parents about special education services. Those panels consist of an educator, a layperson, and a Delaware attorney, who serves as chairperson of the hearing panel. The IDEA recently added hearing officer competency requirements to ensure IDEA appeals are heard professionally. This Act amends state law to give the Department more flexibility in appointing attorney panel members who meet IDEA competency requirements but may not practice law in Delaware.
