Summary
This bill amends Chapter 85, Title 11 of the Delaware Code to clearly establish what shall be the primary jurisdiction where a missing person’s complaint must be filed for purposes of determining which law enforcement agency shall be primarily responsible for receiving and taking a missing person’s complaint and assuming the investigation to locate the missing person. The bill specifically states that the law enforcement agency having primary jurisdiction over the verified location where the missing person was last seen shall be responsible for taking a missing person’s complaint and assuming the investigation. If the location where the missing person was last seen cannot be verified, the law enforcement agency having primary jurisdiction over the missing person’s last known place of residence shall be responsible for taking the missing person’s complaint and assuming the investigation.
