Summary
This legislation amends the Medical Practice Act to address home health care services ordered for Delaware residents by physicians from another state. This legislation allows a Delaware licensed home health agency to deliver home health care to a patient who resides in Delaware upon an order of a physician from another state who holds a license in good standing in the other state. The intent of this legislation is to permit individuals who have sought medical treatment in another state and need subsequent home health care services to obtain those services without obtaining an intermediary Delaware physician to write an order for home health care services to be rendered in Delaware.
