This Bill implements recommendations made by the Joint Sunset Committee following its review of the Board of Charitable Gaming. The Bill: 1) Combines into one chapter the three chapters for bingo, charitable gaming, raffles and Texas Hold’em Poker which currently govern the Board of Charitable Gaming. It retains a majority of the language from the prior statutory provisions, but does include some changes. 2) Makes clear that the Division of Professional Regulation is responsible for the administrative, budgetary and investigative functions of the Board. 3) States the powers of the Board, rather than the old law referring to it having the powers of the former Bingo Control Commission. 4) Provides that officers of charitable gaming vendors undergo a background investigation at their cost and for a fee, including a check of their criminal histories, before being considered for licensure. 5) Restricts sitting Board members from being elected officers of any national, state or local professional or non-profit organization that qualifies them for appointment to the Board. 6) Makes a technical correction to SB 131 (Amending Title 28 relating to Charitable Gaming) by adding specific required language enabling federal criminal background information to be obtained for third-party vendors. 7) Explicitly lists raffles as a form of charitable gaming. 8) Allows the sale of alcoholic beverages pursuant to the Delaware Liquor Control Act at charitable gaming events but not at bingo events. 9) Changes the time when bingo games can begin from 1:30 to 12 noon.
